How to change power legally?
When we talk about power in Russia, we usually mean the president and the government. Or rather, President Medvedev and Prime Minister Putin, without even separating their positions from their surnames. They are sometimes called the Kremlin and the White House or the duumvirate. People have no doubt about this obviousness in their opinion. And television imposes such an opinion every day and hourly. The named characters themselves, making important government decisions without demand, fear, and often contrary to public opinion, seem to have merged with the role of supreme rulers. At the same time, we have reasons to ask about who is the power in Russia? Moreover, today’s order does not suit many - after all, the people’s hands are practically tied, and the state government does what it wants, how it wants and when it wants in any area.

Thinking about this power not superficially, you discover very important things that can be called a disproportionate restriction of the rights and freedoms of the people against the backdrop of an increase in the personal power of specific individuals. The result of this imbalance is the destruction of industry, agriculture, army, science, education, social protection, morality, and all other foundations of our country with the sky-high enrichment of those who are in power.

The so-called government has secured itself from all sides - it has adopted so many laws and amendments to them, so provided itself with rights and powers that it feels practical impunity and invulnerability. At the same time, she freely disposes of her rights, our responsibilities, our national wealth and budget money, and our security, and they act so unnecessarily, unaccountably and deceitfully that you understand that this cannot continue for long. And the only question is when and how tragically will all this end?

Medvedev and Putin have state attributes, security forces and departments, legislators, officials, judges and prosecutors obey them, they are presented by the media, they are accepted in the world. At the same time, they do not fulfill the promises made to the people. That is, on the one hand there are attributes, instruments of power and external recognition, on the other hand there are us - the people who do not know how to influence this power for their own good.

All this rests on the money of developed countries, which they pay to the Russian authorities for our oil and gas, and the authorities use this money to strengthen their permissiveness, our lawlessness and the economic power of the same developed countries. From which we can conclude that foreign countries are involved in the creation of such a scheme. After all, the answer to the traditional question: “Who benefits from this?” it will be exactly like this.

Accusations are increasingly heard against this “authority”. Of course, they do not sound on television, since they also control television, but in books, newspapers, the Internet, and at rallies. The charges are very serious, ranging from corruption and the largest theft in the history of mankind, from the massacre of civilians, including the massacre of children, to betrayal of the interests of the country, high treason and the seizure of all power. There are enough grounds for such accusations, and if they start to be heard truly publicly, the consequences can be thunderous. At the same time, massacres are explained by political motives, which translates them into the category of classic terrorism.

It is not clear whether this government despises us, or is arrogantly testing our strength, or is provoking us to do something? But the forecasts are generally disappointing. The lack of a perspective acceptable to the majority is generally a dangerous thing. And in order to extinguish this danger, they pour rivers of vodka, beer, endless shows on us, bring in tons of drugs, send detectives from the FSB snooping around everywhere.

What can be done in such a situation, you ask. Let's reason:

Firstly, behavior in such conditions was clearly stated 200 years ago. I quote: “If a long series of abuses and violence, invariably pursuing the same goal, reveals a desire to subject the people to absolute despotism, then it is the right and duty of the people to overthrow such a government and create new guarantees for ensuring their future security.” Said by the authors of the US Declaration of Independence, as we see for centuries. Like this.

Whether what is happening in our country is a desire to subject the people to despotism, decide for yourself. In my opinion, this is still a soft definition. In fact, we need to talk about despotism with the goal of destroying our peoples and our great country. Consequently, it is our duty as a people, according to eminent Americans, to overthrow such a government and create new guarantees for our future security.

I understand that there will be groans and accusations of calls for a violent change in the constitutional system, as well as corresponding threats. But take your time. It was not me who said this, but world-recognized authorities whose statements were not prohibited in court. There is a right to the necessary defense. Moreover, in order to understand this issue, we read what the main and main Law of our country, the Constitution, writes on this subject.

Who is our authority?

The Basic Law says that the only source of power in Russia is its multinational people (Article 3, paragraph 1). I repeat - the only source of power. I think there is no need to explain the meaning of the word “source” - this is the name of what gives rise to power, where power comes from. This source is you and me, the people, and no one has the right to deprive us of this. We will establish whatever power we want in accordance with the foundations of the Constitutional system.

Further, the Basic Law states that the people exercise their power directly, that is, without any kind of intermediaries in the form of presidents, prime ministers, the State Duma, police, officials, courts, prosecutors and the FSB combined. Only we ourselves, the people, exercise the highest power in the country and no one else has the right to replace us in this. No one anywhere has given us a decree here, including the governments of foreign countries. We the people of Russia are the source of power and we exercise this power ourselves, directly. We are the highest authority, period.

Only after this, separated by a comma in the Law, it follows: “..., as well as through state authorities and local governments.” That is, first of all, we ourselves, the people, exercise the highest power in the country. And only then we do this through state and local government bodies on current minor issues. It is in this sequence that the Constitution sets out this, this is its meaning and its form, no matter what the inflated “rulers” and their servants think or sing to us about it.

The Basic Law also clearly states how we, the people, exercise our power: “the highest direct expression of the power of the people is a referendum.” This means that a referendum, according to the Main Law of the country, is the highest direct power of the people. Also the highest power is, as added, free elections.

That is, we the people, the source of power, exercise this power ourselves on the most important issues through referendums. And we entrust the rest of the minor executive issues, the so-called “turnover”, to state authorities and local governments, which we elect in free elections. A referendum must also be free, as follows from its definition and the meaning of the article of the Constitution. Any other form of power in the country is unconstitutional.

Now, dear fellow citizens, let's remember when was the last referendum in Russia? That is, when was constitutional power exercised in our country? I myself had difficulty remembering that the last time the All-Russian referendum was held was on April 25, 1993, when, in addition to the question of confidence in President Yeltsin, the people voted for the adoption of the current Constitution, which is what we are talking about. This event can be considered the last constitutional action in our country.

Later, there was not a single case of all-Russian referendum on a single issue. Consequently, the country has been living outside the constitutional system for seventeen years now. Therefore, is it worth surprising at the destructiveness and ugliness of the evil happening today? The power is illegal.

Moreover, through the efforts of Vladimir Putin, Boris Nemtsov and their campaign, amendments to the legislation were adopted in 2002, making holding a referendum almost impossible. And the fact that there have been no referendums all these long years irrefutably proves their practical impracticability. That is, objectively speaking, these figures changed the foundations of the constitutional system of the Russian Federation many years ago with lies, cunning and violence. So who should be blamed for the forcible change of the constitutional order and the forcible retention of power, if not them?

It follows from this that all decisions regarding vital issues over the past years are unconstitutional. These decisions, if we remember, changed our entire lives radically. And in such cases, any decisions that affect the interests of a significant group of the population, not to mention the fundamental interests of the entire people of the country, are considered important. For example, in Switzerland a national referendum is even held on the issue of building a tunnel through the Alps - and this is a worldwide practice.

The same Vladimir Putin, by the way, specialized in the KGB in Switzerland, knows its structure well, and the location of the scandalous companies Gunvor and RosUkrEnergo, with which his multibillion-dollar capital is connected, was chosen in Switzerland. For this reason, he will not be able to plead ignorance and we can confidently assume that V.V. Putin violated the foundations of the constitutional system of Russia, giving a full account of what he had done, in order to arrogate power to himself.

No one can appropriate power in the Russian Federation. Seizure of power or appropriation of power is punishable by law (Article 3, Clause 4).

These are unconstitutional decisions

Let us remember how many changes were imposed on us during this period on vital issues that were resolved without referendums, that is, unconstitutionally:

These include:

— cancellation of elections of heads of federal subjects;

— cancellation of elections of members of the Federation Council;

— abolition of elections of State Duma deputies in single-mandate constituencies;

— increasing the threshold for parties to enter the State Duma from 3 to 7 percent;

— restrictions on the creation of parties and movements;

— limiting the timing of referendums and effectively banning them;

— abolition of the lower threshold for voter turnout;

— extension of the terms of office of the president and State Duma deputies;

— adoption of a law on extremism and increasing the powers of the FSB;

— other important decisions related to the internal political structure of the country.

These include:

— the decision on Russia’s accession to the WTO, which resulted in the destruction of agriculture and industry;

— the decision to accede to the Treaty with NATO (FZ-99), which allows the introduction of alliance troops with weapons into Russian territory and conduct full-scale military operations against the Russian army, police and resistance forces on “legal” grounds;

— decision to alienate 337 sq. m. in favor of China. km of Russian territory near Khabarovsk;

— the decision to hand over to China all mineral deposits in Eastern Siberia and the Far East (half of the country’s territory);

— the decision to place half of our gold and foreign exchange reserves in the United States;

— the decision to build oil pipelines to China and Germany;

— questions about forgiveness of large debts to other countries;

— other important territorial, foreign policy and foreign economic decisions.

This also includes:

— decision to eliminate benefits;

— the decision to sharply reduce the army, navy, and aviation;

— decision to reduce nuclear forces and strategic enterprises;

— decision to place gold and foreign exchange reserves abroad;

— decisions to change the procedure for acquiring land, forests and reservoirs; the decision to liquidate RAO UES and transfer other monopolistic companies, including the fuel and energy complex, into private hands;

— decision to create RAO Russian Railways;

— decision on the import of nuclear waste from other countries;

— decision to change time zones;

— the decision to liquidate the police and create a police force;

— the decision to stop state funding of all schools, clinics, hospitals, museums, etc. (comes into force in January 2011);

— a project to radically change the territorial organization of the country;

— other important economic, political and environmental decisions.

What is the legal force of these decisions? None. They are illegal from the moment they are adopted. Because they were adopted in violation of the Constitution. We must not submit to them. We, the people of the country, did not accept them and did not entrust anyone with accepting them for us. Consequently, not only we, but also government bodies at all levels are not obliged to fulfill them. And, if only these bodies initiate, make and implement such decisions, then we need to look at whether they are bodies of state power at all?

What are public authorities?

Again we turn to the Constitution. It states that the people exercise their power directly, as well as through state authorities and local governments (Article 3, Clause 2).

Thus, it is we, the people, who exercise our power through the bodies of state power, and not these bodies themselves replace our opinion of the people. Consequently, the decisions of public authorities on such important issues are insignificant, since they were carried out in excess of their powers and in violation of the boundaries of the Basic Law of the country. They violated the constitutional order many times.

The form of entry in the Basic Law of the Russian Federation in relation to public authorities (“and also”) indicates that the significance of the decisions of these bodies in relation to free referendums of the people is secondary. These bodies cannot replace referendums on important issues, even if they were created in accordance with the Constitution.

And now it is appropriate to talk about how constitutional today’s government bodies are, including the President, the Government, the State Duma, the Federation Council, governors and all those who are called such authorities today, whose orders are listened to, who spend our money, enjoy all the privileges.

The fact is that the country's Constitution unambiguously binds the people, as the source of power, the powers that the people give to government bodies and the procedure for transferring powers through free elections. It is necessary to especially emphasize this word of FREE, only FREE and necessarily FREE elections (Article 3, paragraphs 1,2,3). Otherwise, government bodies are not legitimate.

The meaning of the term “free elections” can hardly be understood otherwise than as unrestricted, carried out from the maximum possible number of options (including the choice “against all”), not constrained by pressure, unequal conditions of campaigning, and especially not distorted by rigging election results. And this is where obvious questions and substantive claims begin.

Even if we leave behind the elections of 1996 and 2000, there are a lot of complaints about the elections of 2003-2004, and especially 2007-2008. Starting, as was said, with changing the electoral legislation without nationwide referendums. Because of this, a large number of likely candidates were not allowed to participate in these elections, the people were deprived of truthful information, there was no “against all” column, and the number of voters dropped sharply. Free elections were no longer entirely certain.

In addition, parties allowed to participate in the elections were arbitrarily limited in their access to the media. The preparation and process of voting was controlled and managed by numerous intelligence officers, as there is ample evidence of this. Numerous cases of ballot stuffing for the “party in power”, abuse of absentee ballots and inconsistencies in commission protocols have been noted.

The voting results were most likely rigged using the GAS-Elections electronic vote counting system, which the people could not control, and the hasty announcement of the voting results is clear evidence of this. For comparison, in Ukraine votes are counted for weeks, despite the fact that the country is much smaller than our country, the ballot boxes there are transparent, etc., etc.

Consequently, there can be no talk of free elections in 2003-2008. There were no free elections during this period, regardless of whether Western countries recognized this fact or not. The source of power in Russia is our people, not the West.

So is there a president in Russia?

Based on the totality of signs, all of the above means that there are no constitutional bodies of state power in Russia today, since in 2003-2008 they were not created in accordance with the Basic Law of the country, and the old ones have exhausted their powers.

Therefore, Dmitry Medvedev is not the President of the Russian Federation and Commander-in-Chief. Let it cool down. The State Duma does not consist of deputies. Together with the Federation Council, it is not a body of representative power of the country. Vladimir Putin, appointed by them, is not the Chairman of the Government of the Russian Federation. The presidential administration and its representatives in the federal districts are illegal. All these persons have arrogated to themselves the highest powers of power, which were not authorized by the people according to the Constitution of the Russian Federation, the law of the highest legal force.

The Prosecutor General, all ministers, including the Minister of Defense, the Ministry of Internal Affairs and the director of the FSB, the Federal Security Service, the Ministry of Emergency Situations, their deputies, as well as the heads of regional departments, the leadership of federal television and radio companies and natural monopolies are also not legal.

The heads of regions appointed by D. Medvedev and V. Putin are not a body of state power, nor are those whom these supposed “governors” appointed themselves.

All judges, like those appointed by V. Putin and D. Medvedev, are not competent. The only exception, if I’m not mistaken, are the judges of the Constitutional Court, appointed for life in the 90s, but only in the composition that was before Putin, including judges who left their positions under his pressure.

In addition, all laws, decrees, resolutions and decisions adopted by the named persons during this period are invalid. Not a single reform, not a single order of theirs, is subject to execution, including the reform of the army and police, at least until the moment when free popular referendums are held and legal bodies of state power are created.

The same applies to the legislative assemblies of republics, territories and regions, as elected according to party lists in conditions of non-free elections.

Thus, out of the three branches of government - legislative, executive and judicial, only a few people in the judicial branch can be considered as such.

Since free elections are a condition for the legitimacy of local self-government bodies, the only legitimate executive body on the territory of Russia today can be those rare freely elected mayors of cities and heads of rural settlements.

Moreover, their list does not include the cities of Moscow and St. Petersburg. In fact, there are no local government bodies in both capitals at the management level, unless we consider as such the powerless and helpless structures under the Moscow councils, which always act as petitioners for these councils. Again, there were no free elections here. So, in Moscow and St. Petersburg there is no power - neither executive, nor legislative, nor judicial, nor local self-government. This supposed power failed itself, despising the Highest direct expression of power by the people.

What to do?

After realizing everything, a natural question will arise, what to do in this situation? The answer to it will depend on the behavior of the so-called authorities, who, apparently, illegally and temporarily occupy the highest government positions in the country.

The optimal thing would be to stop all the reforms they have started. Suspend all previously adopted without a referendum political restrictions on elections and the creation of parties and movements. And everyone, that means everyone. Announce your temporary status. Engage in supporting the functioning of life support systems, protecting high-risk facilities and nuclear forces, suppressing domestic crime and protecting political leaders and parties. At the same time, set a date for holding an all-Russian free referendum on issues of trust in D. Medvedev and V. Putin and free elections. Create all the conditions for their organized holding, including free access for opposition parties and movements to federal television channels, holding rallies, meetings, processions, transparent vote counting, etc. However, this is hard to believe. In any case, without our mass actions, even this will not happen.

The level of lies, deceit, dishonesty and outright meanness of some “rulers” most likely has crossed all boundaries and in order to maintain themselves at the top, as well as to preserve the system that is destroying the country built with their help, they and their Western patrons are ready to commit any of the most inhumane and serious crimes, trampling down the right, silencing the voices of truth, knocking out the leaders of the people, even to the point of inviting NATO troops to Russia, provoking war and new massacres.

In this case, there is only one thing left - to use the people’s power directly, including the removal of these persons from their positions, a public investigation of their activities and the announcement of the same referendum and elections. We have the right to seek help from other countries, including Belarus, Ukraine, and Kazakhstan. It is not so important that such procedures are not prescribed in the laws.

The fact is that in jurisprudence there is the concept of pre-emptive right and the application of legislation by analogy. In cases where relations are not directly regulated by law, legislation regulating similar cases and relations is applied.

In any case, since there are practically no government bodies in the country, it is necessary for the only legitimate source of power to act - the people of the country with the Constitutional Court. Why create an initiative group, convene and organize an all-Russian constituent assembly to hold free elections and referendums in the country. Nobody but us will do this. Citizens of the Russian Federation have the right to participate directly in the management of state affairs, and also have the right to participate in the administration of justice (Article 32, Clauses 1 and 5).

In this case, we are not talking about a violent seizure of power on our part in order to overthrow or forcibly change the constitutional system of the Russian Federation. On the contrary, we are talking about restoring the constitutional order and bringing to justice those guilty of forcibly seizing and retaining power in violation of the Constitution of the Russian Federation, exceeding their official powers, obstructing the exercise of electoral rights and justice, etc., etc. And this radically changes things.

A lot here depends on the position of the law enforcement agencies. Perhaps they will take the side of the people and help deal with the organization quickly. Maybe someone will prefer to defend Medvedev and Putin. In any case, it is worth recalling that the orders and instructions of these supposedly superior and high-ranking bosses here will be obviously illegal with all the ensuing consequences. Moreover, since Putin’s accusations of terrorism are justified, his defenders will also be considered accomplices of terrorists, who, as Medvedev himself recently said, “if they resist, are destroyed.”

You may ask, what about Article 31 of the Constitution, “Citizens have the right to assemble only peacefully without weapons, to hold meetings, rallies, demonstrations, processions and picketing?” Yes, it really is written that way. But even earlier, the Fundamentals of the Constitutional System stated that the only source of power in Russia is its people. It's up to him to decide.

Nobody anywhere has forbidden and cannot forbid the people to gather with arms, non-peacefully, to defend the constitutional order and restore constitutional order in the Russian Federation by using measures of physical coercion against persons suspected of terrorism, seizure of power, betrayal, treason and other serious state crimes. This is what we will be forced to do. What is not prohibited is, as we know, permitted.
